Police: ‘No evidence of a crime or a sexual assault’ in incident involving Colin Kaepernick

Miami Police confirmed Thursday that San Francisco 49ers quarterback Colin Kaepernick, wide receiver Quinton Patton and Seahawks wide receiver Ricardo Lockette are linked to a police investigation involving a woman who woke up in a hospital after spending time with the players, Bay Area News Group’s Natalie Neysa Alund and Cam Inman wrote.

What the police did not confirm was a report by TMZ Sports that Kaepernick was being investigated for a possible sexual assault. Miami Police spokesman Rene Pimental debunked that Thursday, saying the celebrity news site “took the report out of context.”

“There’s no evidence of a crime or a sexual assault,” Pimental said, according to Alund and Inman. “This report is simply an incident report taken at the woman’s request.”

A four-place police report says the incident involved a woman with whom Kaepernick reportedly had a past sexual relations, and took place April 1 at Lockette’s Miami apartment.

No arrests have been made, and no charges have been filed.

Teams have not released any information about the report, though 49ers general manager Trent Baalke said in a statement Thursday, “The 49ers organization is aware of a report regarding Colin Kaepernick and are gathering facts.”

49ers coach Jim Harbaugh told ESPNWestPalm.com, “I’m aware (of the incident), but don’t have anything else that I know anything about.”

Harbaugh was attending 49ers receiver Anquan Boldin’s charity function, Q-Fest, in Palm Beach Gardens, Fla. Kaepernick was also scheduled to attend.

In it, the woman tells detectives she went to Lockette’s apartment at the Viceroy Miami, a luxury resort, to hang out with Kaepernick and Patton, and that she “mixed some drinks for all of them and gave them shots.”

They then watched a basketball together. The woman said she was feeling light-headed and went to a bedroom to rest. Kaepernick eventually joined her. He kissed her and undressed her, but, as she told police, they did not have sex that night.

Kaepernick left her naked in the bedroom. Later, Patton and Lockette opened the door and peaked inside. She asked where Kaepernick was, then told them to “get out.” They left immediately.

The woman says she woke up in a hospital an unspecified amount of time later. How she got there was not explained in the police report.

Lockette, 27, was cut by the 49ers during training camp last year. He had shared a house with Kaepernick, 26, according to the Bay Area News Group story. Lockette then signed with the Seahawks and was on on their Super Bowl-winning team.

The 23-year-old Patton is entering his second season with San Francisco.
